Finish a Garden Room

Where do I stand if I have had a trade come in to complete a garden room and patio but then left a job half finished and I have paid £1500 deposit? Can I get someone else to complete it?

"Hi Gavin,
Only if you're 100% certain that he is not gonna come back and finish the job and if you feel that you've had good value for money then you can appoint another tradesmen or company to price for the remainder of the works.
From a legal perspective, you need to take photographs so that you can ascertain the amount of work that was involved and the amount of materials that been used have reached the price that you have paid.
Once you are happy that you have a cut-off for the value that you've already paid, then you should be able to appoint another trade person to give you another price to finish the whole job.
You may need to seek legal advice.

"Hi there.

As a trades man my self it usually costs more to complete other people's work as we don't know what we are coming into and can be very problematic and stressful at most. How ever if you paid a deposit already you should really be trying to track down these guys and have several attempts at trying to get them to rectify things before looking for other help."

To be slightly higher then previous due to mobilisation cost. When a company starts a job they spend on mobilisation and that will always be the case for each contractor that comes in"

The first thing I would want to know is if you have all the materials still on site?
If you do then, I would say that the £1500 has probably covered the cost of materials, so your not to bad off.
In regards to getting someone else in to finish the work, yes you definitely can do. There are many companies that can come in and finish the job for you You just want to make sure that you get someone who is reliable and happy to finish the work that is started. Best thing to do is get someone in, to have a look at the situation and if they are good enough, they should be able to ask all the right questions, so you know that they can do the job.

"Yeah you can. You have a right to get your job completed. Then contact the initial tradesman to get a full or partial refund and if that's unsuccessful you can take them to small claims court."

"Yes.. have you expressed your concerns to the builder? If you’re not happy with the work or the timeframe of completion you can hire another trades person. I would do my best to get the original tradesman to finish as you agreed first. It’s a red flag to other tradesmen to pick up a job half way through not only is it harder to complete the job because you may work differently to the original person you will also be asking yourself why he hasn’t finished the job himself"

"I would try to contact the trade person that the initial agreement was made with and attempt an amicable solution for completing the work.

If this isn't a solution then there's nothing wrong with contacting another trade person. Some things to consider; the new trade person is unaware of what has previously happened regarding the construction and the relationship between client and service man. So best to be as open and clear with expectations so they're able to provide the best service and results possible.

"Your best solution would be to seek advice from citizens advice, this can be a tricky problem, it depends on how much work they have done, and if you're out of pocket and what contract you had in place."

"I would require more detail to give you accurate advice on this; have you attempted to make contact with the contractor? What were the original terms you agreed with the contractor? I.e the whole scope of the work they would be responsible for etc.
What was the whole sum cost agreed? You can get someone else to complete it, you may then forfeit any obligation left on the other contractor to come and finish the work as someone else has started."
